National Electric Vehicle Infrastructure (NEVI) Formula Program Update

Background

The Federal Highway Administration (FHWA) has issued an Interim Final Guidance for the National Electric Vehicle Infrastructure (NEVI) Formula Program, consolidating and replacing all prior NEVI policy documents. The update is designed to accelerate EV charging station deployment, reduce administrative burdens, and give states more flexibility in meeting local needs.

Updates Made:

  • All prior NEVI guidance rescinded; only statutory and regulatory requirements remain.
  • Streamlined State EV Infrastructure Deployment Plans – no longer require extensive equity, resilience, or consumer protection sections beyond what is legally required.
  • 50-mile corridor spacing rule removed – states may set their own charger distances.
  • Community engagement scaled back – limited to minimum requirements.
  • Greater flexibility in build-out certification – states can define when Alternative Fuel Corridors are “fully built out” to redirect funds statewide.
  • Planning requirements reduced – renewable energy integration, emergency planning, and resilience considerations are optional unless required by law.
  • Encourages host-owned charging sites to speed installation.
  • 30-day submission deadline for updated State Plans following release.

Eligible uses:

  • EV charger acquisition and installation (light-, medium-, and heavy-duty).
  • Operating assistance for up to five years for NEVI-funded chargers.
  • Traffic control devices and signage.
  • Planning, feasibility studies, mapping, and modeling activities.

Eligible Applicants

Eligible applicants include State Departments of Transportation (including DC and Puerto Rico).

Important Dates

New guidance was released on August 11, 2025, with a state plan deadline of September 10, 2025.
